Dive Trip Terms & Conditions

Rise & Dive reserves the right to update these Terms & Conditions at any time. Continued booking, payment, or participation after updates constitutes acceptance of the revised terms.
By registering for and submitting payment toward a trip, retreat, or event operated by SocialNicole LLC, doing business as Rise & Dive, you agree to the following Terms & Conditions.
1. Reservations, Deposits, and Payments
A non-refundable deposit is required to reserve your space.
All deposits and payments are non-refundable. Travel insurance is strongly recommended.
Remaining balances must be paid in full by the stated deadline. If payment is not received by the due date, your reservation may be canceled and payments forfeited.
Rise & Dive commits to vendors and accommodations in advance. Your payment secures real space, real contracts, and real costs.
2. Cancellation by Participant
If you cancel for any reason, including illness, injury, work conflicts, travel disruptions, airline changes, personal circumstances, government advisories, or a change of plans, your cancellation is considered voluntary.
All deposits and payments are non-refundable.
Rise & Dive contracts in advance with third-party suppliers, including dive operators, resorts, boats, and transportation providers. Cancellation penalties begin at the time of booking.
Replacement Policy
If you cancel, Rise & Dive may attempt to fill your spot.
If a replacement participant is confirmed and fully paid, you may receive a refund of amounts paid minus:
• The non-refundable deposit
• Up to 50% of the remaining balance to cover administrative and replacement-related costs
• Any non-recoverable supplier penalties
Replacement is not guaranteed. If the spot is not filled, no refund will be issued.
3. Force Majeure and Global Events
Some events are outside anyone’s control. These include, but are not limited to:
• Pandemics or public health emergencies
• Government shutdowns or border closures
• Mandatory quarantines
• Airline cancellations
• Natural disasters or severe weather
• Political instability or civil unrest
• Acts of terrorism
• Travel advisories
• Acts of God
• Any circumstance beyond the reasonable control of Rise & Dive
Participant Cancellation Due to Global Events
If you choose not to travel due to a global event or force majeure circumstance, your cancellation remains voluntary and subject to the non-refundable policy above.
Travel insurance, including optional cancel-for-any-reason coverage, is your primary financial protection for these situations.
Trip Cancellation or Postponement Due to Force Majeure
If a force majeure event prevents the trip from operating as planned, Rise & Dive reserves the right to cancel, postpone, or modify the itinerary.
If the trip is canceled due to force majeure, participants will receive a future travel credit equal to 100% of payments made directly to Rise & Dive.
Credits:
• Are valid for 24 months from the original trip start date
• May be applied toward any Rise & Dive trip
• Are non-transferable unless approved in writing
• Have no cash value
• Are not redeemable for cash
Refunds will not be issued in force majeure situations, as funds are typically committed to third-party partners.
If a trip is postponed and you cannot attend the new dates, the credit policy applies.
Rise & Dive is not responsible for airfare, travel insurance premiums, gear purchases, or other third-party costs.
4. Cancellation by Rise & Dive Within Its Control
If Rise & Dive cancels a trip for reasons within its direct control and not related to force majeure, you will receive a full refund of payments made directly to Rise & Dive.
Rise & Dive is not responsible for additional travel expenses outside the trip package.
5. Minimum Enrollment
Some trips require a minimum number of participants to operate.
If minimum enrollment is not met, Rise & Dive reserves the right to cancel the trip. In such cases, you will receive either a full refund of payments made directly to Rise & Dive or a future travel credit.
6. Double Occupancy and Roommate Policy
If you register for double occupancy without a confirmed roommate, Rise & Dive will attempt to match you.
If a roommate cannot be secured, you will be responsible for the single occupancy rate.
If a roommate cancels and no replacement is found, the remaining participant may be required to cover the single occupancy difference.
Room assignments are at the discretion of Rise & Dive and the hosting property.
7. Dive Requirements and Medical Fitness
Submission of a completed Diver Medical Form is mandatory.
If physician clearance is indicated, written approval must be provided prior to participation.
Participants must meet all certification and experience requirements listed for the trip.
Failure to provide required documentation or meet certification standards may result in denial of participation without refund.
Rise & Dive reserves the right to remove a participant from diving activities or from the trip if, in its reasonable judgment, the participant’s health, diving ability, or behavior presents a safety risk. No refund will be issued in such cases.
8. Assumption of Risk and Liability
Scuba diving, snorkeling, mermaiding, boating, and international travel carry inherent risks.
By participating, you voluntarily assume all associated risks.
To the maximum extent permitted by law, Rise & Dive’s total liability for any claim arising out of participation shall not exceed the total amount paid by the participant to Rise & Dive for the trip.
Participants will be required to sign liability waivers from Rise & Dive and third-party operators.
9. Third-Party Suppliers
Rise & Dive acts as an intermediary between participants and independent suppliers, including dive operators, accommodations, and transportation providers.
Rise & Dive is not responsible for the acts, omissions, or performance of third-party suppliers.
10. Travel Documentation
Participants are responsible for valid passports, required entry documentation, airline policies, and destination requirements.
Failure to obtain proper documentation does not qualify for a refund.
11. Travel Insurance
Travel insurance is strongly recommended and may be required for certain trips.
Recommended coverage includes trip cancellation, interruption, medical expenses, emergency evacuation, dive accident insurance, and cancel-for-any-reason coverage where available.
12. Code of Conduct
Rise & Dive trips are designed to foster a supportive and respectful environment.
Unsafe diving practices, harassment, disruptive behavior, or refusal to follow professional instruction may result in removal from activities or dismissal from the trip without refund.
13. Chargebacks and Payment Disputes
If a participant initiates a chargeback or payment dispute for a charge that was authorized and agreed to under these Terms & Conditions, Rise & Dive reserves the right to recover associated administrative fees and costs incurred in responding to the dispute.
14. Photography and Media
Photos and videos may be taken during trips for community and marketing purposes.
By participating, you grant permission for use of your image unless you notify Rise & Dive in writing prior to the trip.
15. Governing Law
These Terms & Conditions are governed by the laws of the State of Minnesota, without regard to conflict-of-laws principles.
Any dispute, claim, or controversy arising out of or relating to participation in a Rise & Dive trip shall be resolved exclusively in the state or federal courts located in Hennepin County, Minnesota.
By registering for a trip, you consent to the personal jurisdiction and venue of such courts.
