Dive Trip Terms & Conditions

Rise & Dive reserves the right to update these Terms & Conditions at any time. Continued booking, payment, or participation after updates constitutes acceptance of the revised terms.
By registering for and paying for a trip, retreat, or event operated by SocialNicole LLC, doing business as Rise & Dive, you agree to the following Terms & Conditions.
1. Reservations, Deposits, and Payments
A non-refundable deposit is required to reserve your space.
All deposits and payments are non-refundable.
Remaining balances must be paid in full by the stated deadline. If payment is not received by the due date, your reservation may be canceled and payments forfeited.
Rise & Dive commits funds and contractual obligations to third-party suppliers, accommodations, dive operators, transportation providers, and related travel expenses in advance of each trip.
Payments are not contingent upon actual participation, dive conditions, weather conditions, ocean conditions, or completion of planned activities.
2. Cancellation by Participant
If you cancel for any reason, including illness, injury, work conflicts, travel disruptions, airline changes, personal circumstances, government advisories, weather concerns, personal risk tolerance, or a change of plans, your cancellation is considered voluntary.
All deposits and payments are non-refundable.
Rise & Dive contracts in advance with third-party suppliers, including dive operators, resorts, boats, accommodations, and transportation providers. Cancellation penalties and unrecoverable costs may begin at the time of booking.
Replacement Policy
If you cancel, Rise & Dive may, at its sole discretion, permit a replacement participant to take your place on the trip.
Any replacement participant must:
- Be approved by Rise & Dive
- Meet all trip requirements and qualifications
- Complete all required registration documents and payments
- Pay any applicable pricing, fees, rate differences, or trip costs required by Rise & Dive
Replacement arrangements, including pricing, discounts, credits, transfers, or substitutions, may only be coordinated or approved directly through Rise & Dive.
If a replacement participant is confirmed and fully paid, the original participant may receive a partial refund of amounts paid, less:
- The non-refundable deposit
- An administrative transfer and processing fee determined by Rise & Dive
- Any discounts, promotions, credits, reduced pricing, or pricing adjustments applied to the replacement booking
- Any unrecoverable supplier penalties, fees, expenses, or contractual costs
- Any payment processing, banking, currency conversion, or transaction-related costs
Replacement approval is not guaranteed and remains solely at the discretion of Rise & Dive.
If a replacement participant is not secured and fully confirmed, no refund will be issued.
3. Force Majeure and Global Events
Some events are outside anyone’s control. These include, but are not limited to:
- Pandemics or public health emergencies
- Government shutdowns or border closures
- Mandatory quarantines
- Airline cancellations or disruptions
- Natural disasters or severe weather
- Unsafe ocean or diving conditions
- Political instability or civil unrest
- Acts of terrorism
- Travel advisories or restrictions
- Mechanical failures
- Acts of God
- Any circumstance beyond the reasonable control of Rise & Dive or applicable suppliers
Participant Cancellation Due to Force Majeure or Global Events
If you choose not to travel or participate due to a force majeure circumstance, global event, travel concern, weather event, airline disruption, government advisory, personal risk tolerance, or related circumstance, your cancellation remains voluntary and subject to the standard cancellation and non-refundable payment policies above.
Travel insurance, including optional cancel-for-any-reason coverage where available, is your primary financial protection for these situations.
Trip Cancellation or Postponement Due to Force Majeure
If a force majeure event prevents a trip from operating as planned, Rise & Dive reserves the right to cancel, postpone, modify, substitute, shorten, extend, or otherwise alter any aspect of the trip itinerary, accommodations, activities, transportation, dive operations, or schedule.
Force majeure determinations shall be made at the sole discretion of Rise & Dive and applicable suppliers.
Refunds are not guaranteed in force majeure situations, as funds may already be committed to third-party suppliers, dive operators, accommodations, transportation providers, boats, guides, or other travel-related expenses.
Any credits, refunds, partial refunds, rescheduling options, substitutions, or alternative arrangements offered by Rise & Dive in connection with a force majeure event shall be made solely at the discretion of Rise & Dive and may be subject to supplier policies, unrecoverable costs, administrative expenses, and operational considerations.
Rise & Dive strongly recommends comprehensive travel insurance, including trip interruption, medical evacuation, dive accident, and cancel-for-any-reason coverage where available.
Rise & Dive is not responsible for airfare, travel insurance premiums, gear purchases, personal expenses, third-party travel costs, or other expenses incurred outside amounts paid directly to Rise & Dive.
4. Cancellation by Rise & Dive Within Its Control
If Rise & Dive cancels a trip for reasons within its direct control and not related to force majeure, refunds shall be limited to amounts actually paid directly to Rise & Dive.
Rise & Dive shall not be responsible for incidental, consequential, indirect, or third-party expenses, including airfare, hotels, transportation, insurance premiums, gear purchases, lost wages, or other travel-related costs.
5. Minimum Enrollment
Some trips require a minimum number of participants to operate.
Minimum enrollment determinations are made solely at the discretion of Rise & Dive.
If minimum enrollment is not met, Rise & Dive reserves the right to cancel the trip. In such cases, participants may receive either a refund of amounts paid directly to Rise & Dive or an alternative arrangement at the sole discretion of Rise & Dive.
6. Double Occupancy and Roommate Policy
If you register for double occupancy without a confirmed roommate, Rise & Dive will attempt to match you.
If a roommate cannot be secured, you will be responsible for the applicable single occupancy rate.
If a roommate cancels and no replacement is found, the remaining participant may be required to cover the single occupancy difference.
Room assignments are made at the discretion of Rise & Dive and the hosting property.
Rise & Dive does not guarantee roommate compatibility.
7. Dive Requirements and Medical Fitness
Submission of a completed Diver Medical Form is mandatory.
If physician clearance is indicated, written approval must be provided prior to participation.
Participants must meet all certification, training, experience, and medical requirements listed for the trip.
Participants are solely responsible for maintaining current certifications, medical eligibility, passports, travel documentation, and required dive documentation.
Failure to provide required documentation or meet certification or medical standards may result in denial of participation without refund.
Rise & Dive reserves the right to remove a participant from diving activities or from the trip if, in its reasonable judgment, the participant’s health, diving ability, conduct, or behavior presents a safety risk. No refund will be issued in such cases.
8. Assumption of Risk and Liability
Scuba diving, snorkeling, mermaiding, boating, ocean activities, and international travel involve inherent risks that may result in injury, illness, emotional distress, property damage, disability, or death.
By participating, you voluntarily assume all associated risks.
Participants will be required to sign separate liability releases and participation agreements issued by Rise & Dive and third-party operators.
To the maximum extent permitted by law, Rise & Dive’s total liability for any claim arising out of participation shall not exceed the total amount paid directly to Rise & Dive by the participant for the applicable trip.
9. Third-Party Suppliers
Rise & Dive acts solely as an intermediary between participants and independent third-party suppliers, including dive operators, accommodations, transportation providers, excursion operators, and other travel vendors.
Rise & Dive does not own, operate, or control third-party suppliers and is not responsible for their acts, omissions, negligence, performance, safety, availability, suitability, financial stability, cancellations, delays, or operational decisions.
10. Travel Documentation
Participants are solely responsible for obtaining and maintaining valid passports, required visas, entry documentation, airline compliance, and destination-specific requirements.
Participants are also responsible for monitoring entry requirements, health requirements, travel advisories, and destination restrictions.
Failure to obtain or maintain proper documentation does not qualify for a refund.
11. Dive Accident Insurance
Active dive accident insurance is required for all participants engaging in diving activities during the trip.
Participants are solely responsible for obtaining and maintaining adequate dive accident insurance coverage prior to participation and may be required to provide proof of coverage before engaging in diving activities.
Failure to obtain or maintain required dive accident insurance may result in denial of participation in diving activities without refund.
For convenience, participants may explore dive accident insurance options through Divers Alert Network (DAN) or other comparable providers.
12. Travel Insurance
Travel insurance is strongly recommended but not required unless otherwise stated for a specific trip.
Recommended coverage includes:
- Trip cancellation
- Trip interruption
- Travel delays
- Emergency medical expenses
- Emergency evacuation
- Cancel-for-any-reason coverage where available
- Coverage for airfare, accommodations, and other travel-related expenses
Failure to obtain travel insurance does not alter, waive, or modify cancellation, refund, payment, or participation obligations.
Participants may explore travel insurance options through Divers Alert Network (DAN) Travel Insurance or other travel insurance providers.
Please note that travel insurance and dive accident insurance are separate types of coverage with different benefits, exclusions, and limitations. Standard travel insurance policies may not include coverage for dive accidents, hyperbaric treatment, dive-related injuries, or scuba-specific emergency evacuation expenses.
Participants remain solely responsible for reviewing and understanding the scope, exclusions, and adequacy of any insurance coverage obtained.
13. Code of Conduct
Rise & Dive trips are intended to foster a respectful, supportive, and safety-conscious environment.
Unsafe diving practices, harassment, disruptive behavior, intoxication, refusal to follow professional instruction, or behavior that negatively impacts the safety or experience of others may result in removal from activities or dismissal from the trip without refund.
Determinations regarding participant safety, conduct, or suitability are made solely at the discretion of Rise & Dive and its representatives.
14. Chargebacks and Payment Disputes
Participants agree to first contact Rise & Dive to attempt good-faith resolution of any concerns prior to initiating chargebacks or payment disputes.
If a participant initiates a chargeback or payment dispute for a charge that was authorized and agreed to under these Terms & Conditions, Rise & Dive reserves the right to recover associated administrative fees, collection costs, legal expenses, and costs incurred in responding to the dispute.
15. Photography and Media
Photography and video may occur during trips for community, marketing, educational, and promotional purposes.
Participants may be asked to sign a separate media consent and release agreement prior to participation.
16. Governing Law
These Terms & Conditions are governed by the laws of the State of Minnesota, without regard to conflict-of-laws principles.
Any dispute, claim, or controversy arising out of or relating to participation in a Rise & Dive trip shall be resolved exclusively in the state or federal courts located in Hennepin County, Minnesota.
By registering for a trip, you consent to the personal jurisdiction and venue of such courts.
Participation is subject to Terms & Conditions and a signed Participation Agreement.
